TERMS OF SERVICE

These Terms of Service govern your use of the Fresh Ink Collective website and your purchase of products from Fresh Ink Collective.

By accessing our website, placing an order, or using our services, you agree to these Terms of Service.

FRESH INK COLLECTIVE

Fresh Ink Collective offers limited-release apparel featuring artwork from participating tattoo artists.

Fresh Ink Collective manages the sale, production coordination, marketing, order processing, and fulfillment of merchandise offered through the website.

FRESH INK DROPS

Certain products are offered as limited preorder releases known as Fresh Ink Drops.

Each initial Fresh Ink Drop typically remains available for approximately 30 days and has a 50-shirt Print Goal.

Customers place and pay for their orders during the preorder period.

Reaching the Print Goal does not end the Drop. Orders may continue to be accepted until the scheduled closing date.

Once a successfully funded Drop closes, final quantities are submitted for production.

UNSUCCESSFUL DROPS

If an initial Fresh Ink Drop does not reach its 50-shirt Print Goal, the merchandise will not be produced and qualifying customer orders for that Drop will be canceled and refunded to the original payment method.

Financial institutions may require additional processing time before a refund appears in a customer's account.

PREORDER ACKNOWLEDGMENT

Fresh Ink Drop merchandise is not in-stock merchandise at the time of purchase unless specifically stated otherwise.

By purchasing a preorder item, you acknowledge that production begins after the applicable Drop closes and successfully reaches its Print Goal.

Production and delivery dates are estimates and may be affected by garment availability, printer schedules, shipping carriers, weather, or other circumstances outside Fresh Ink Collective's reasonable control.

PRICING & PAYMENT

Prices are displayed on the website and are subject to change for future products or Drops.

The standard Fresh Ink Drop shirt price is currently $30, unless otherwise stated on the applicable product page.

Applicable taxes and shipping charges are calculated separately where required.

Payment is collected when the customer places the preorder.

ARTIST SUPPORT

Participating artists earn an Artist Commission equal to 20% of qualifying retail merchandise sales featuring their selected artwork.

At the current standard $30 Fresh Ink Drop shirt price, this represents $6 to the featured artist for each qualifying shirt sold.

Shipping charges, sales taxes, refunds, canceled transactions, chargebacks, complimentary merchandise, and other non-qualifying transactions are not included when calculating Artist Commission.

LIMITED AVAILABILITY

Fresh Ink Drops are limited releases.

Fresh Ink Collective does not guarantee that merchandise from a completed Drop will be available again.

Product availability, garment styles, colors, sizes, and future releases may change without notice.

RETURNS, EXCHANGES & CANCELLATIONS

Because Fresh Ink Drop merchandise is produced specifically according to preorder quantities, successfully produced Fresh Ink Drop merchandise is final sale.

Returns or exchanges due to sizing, preference, or change of mind are not accepted.

Customers are responsible for reviewing product descriptions and sizing information before ordering.

If an item arrives damaged, defective, misprinted, or incorrect, please contact Fresh Ink Collective so the issue can be reviewed and appropriately resolved.

ORDER INFORMATION

Customers are responsible for providing accurate billing, shipping, contact, size, and other order information.

If you discover an error, contact Fresh Ink Collective as soon as possible.

We will make reasonable efforts to accommodate changes before production begins, but changes cannot be guaranteed.

Once an order has entered production, it may no longer be changed or canceled.

SHIPPING & FULFILLMENT

Fresh Ink Collective coordinates fulfillment of Fresh Ink retail orders.

Shipping times begin after merchandise has completed production and should not be calculated from the original preorder date.

Customers may receive tracking information when their order is prepared for shipment.

PRODUCT APPEARANCE

We make reasonable efforts to accurately display artwork, garment colors, print colors, placement, and other product details.

However, colors may appear differently between computer monitors, mobile devices, digital proofs, printing inks, and physical garments.

Minor variations inherent to garment manufacturing and screen printing are not considered defects.

ARTWORK & INTELLECTUAL PROPERTY

Artwork appearing on Fresh Ink Collective merchandise remains protected by applicable intellectual property rights.

Purchasing merchandise does not grant the customer ownership, reproduction rights, licensing rights, or other commercial rights to the artwork.

Fresh Ink Collective branding, logos, website content, graphics, and other original Fresh Ink materials may not be copied, reproduced, sold, or commercially used without authorization.

Rights associated with artwork created by participating artists are governed separately by agreements between Fresh Ink Collective and those artists.

PROHIBITED USE

You may not use the Fresh Ink Collective website or its content for unlawful purposes, fraud, infringement of intellectual property rights, interference with website security or operation, or unauthorized commercial reproduction or resale of website content.

THIRD-PARTY SERVICES

Fresh Ink Collective uses third-party services to operate portions of its business, including ecommerce, payment processing, website hosting, shipping, and other services.

Our online store is powered by Shopify.

Use of certain third-party services may also be subject to the applicable provider's terms and privacy practices.

ACCURACY OF INFORMATION

We make reasonable efforts to provide accurate product descriptions, pricing, availability, Drop information, and website content.

We reserve the right to correct errors, inaccuracies, or omissions and to update information when necessary.

LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Fresh Ink Collective will not be responsible for indirect, incidental, special, or consequential damages arising from use of the website or purchase of merchandise.

Nothing in these Terms is intended to limit rights or remedies that cannot legally be limited under applicable law.

CHANGES TO THESE TERMS

Fresh Ink Collective may update these Terms of Service as the business, website, products, or applicable requirements change.

The version posted on the website at the time of use will apply, subject to applicable law.
